Donation terms

Donations are not open yet. These terms will apply when they open.
1. Who receives your gift
Winnie Wishes Trust (“JMjm Trust”), a family trust registered in Kenya (No. TPS-5WC6QD6) and with the Kenya Revenue Authority (KRA PIN P052582847M), P.O. Box 50199-00100, Nairobi, Kenya. The trust is not a registered charity or public benefit organisation. Contact: winniewishestrust@gmail.com, +254 721 439 241.
2. A voluntary gift
Your donation is a voluntary gift. You receive no goods, services or other benefit in return.
3. Tax
The trust does not hold an income-tax exemption from the Kenya Revenue Authority, so donations are not tax-deductible in Kenya. Our acknowledgement is not a tax receipt. If you give from abroad, please check your own country’s rules.
4. How we use your gift
Unless you choose a programme, your gift may fund any of our programmes - education, food and health, confidence and wellbeing, and skills for young people - and reasonable running costs. If you choose a programme and it cannot go ahead or is already fully funded, we will contact you; unless you ask for a refund within 30 days, we will use your gift for the closest similar purpose.
5. Refunds
Donations are final, except when made in error - for example a wrong amount, a duplicate or an unauthorised payment. Contact us within 30 days with your transaction reference and we will refund to the original payment method, less any provider fee that cannot be recovered. Nothing in these terms limits your right to dispute a card payment with your card issuer.
6. Giving by M-Pesa
- Pay to the trust’s Paybill number, which we will publish on our donate page when M-Pesa giving opens, account DONATE. Check that “Winnie Wishes Trust” appears before you enter your PIN.
- Your M-Pesa SMS is your confirmation.
- Paid by mistake? Request a reversal in the M-PESA app or by forwarding the SMS to 456, or contact us. We approve reversals of clear errors within 72 hours.
- Paybill charges: before M-Pesa giving opens, we will state here whether the trust pays them or they are charged to you under Safaricom’s tariff.
7. Giving online by card or M-Pesa
- Online payments are processed by Paystack Payments Kenya Limited. We never see your full card details.
- Amounts are charged in Kenyan shillings; your bank may charge currency conversion fees. We do not add card surcharges; Paystack’s fees are paid by the trust.
- Refunds go back to your card, usually within 3-10 working days, or to your M-Pesa account.
Monthly gifts (card only). When you set up a monthly gift, you authorise the trust to charge the amount you choose to your card on the same day each month (if you start on the 29th-31st, on the 28th) until you cancel. You can cancel at any time online through the “Manage subscription” link in our emails, or by contacting us; cancelling stops all future payments. You will get an email receipt after each payment, and we will tell you at least 7 days before any change to the amount or these terms. A failed payment is not retried.
8. Giving by bank transfer
- Account name: Winnie Wishes Trust. We will publish the bank and account details on our donate page when bank giving opens.
- For international (SWIFT) transfers, please choose the charge option “OUR”; otherwise intermediary banks may deduct fees, and our bank also charges a fee for each incoming international transfer.
- Email us your transfer reference to receive an acknowledgement. Refunds are made by return transfer.
9. Giving from Poland
Donations from Poland are made to Fundacja Harambee Polska (KRS 0000581803), an independent Polish foundation, as a gift with an instruction to support the trust’s work under a written agreement between Harambee and the trust, which will be signed before giving from Poland opens. Harambee’s own terms and privacy notice apply. Your gift may be tax-deductible in Poland under Polish law, but neither Harambee nor the trust can guarantee this. Bank transfer only - no cash collections are made on the trust’s behalf.
10. Large gifts and our right to decline
For gifts above the equivalent of USD 10,000, or anonymous gifts, we may ask who you are and where the money comes from, including when our bank requires it. We may decline or return any donation whose source we cannot verify, that may come from crime, or that comes from a person on Kenyan or United Nations sanctions lists.
11. Acknowledgements and records
We send an electronic acknowledgement with the date, amount, currency, payment channel and reference. We keep records of donations and correspondence for 7 years, to answer questions and payment disputes and to meet our legal duties.
12. Your data
We use your data to process and record your gift and to meet our legal duties. Payment providers may process it outside Kenya under contractual safeguards. We send news only if you opt in, and you can withdraw that consent at any time. See our privacy notice.
13. Age
Donors must be 18 or older, or give with a parent’s or guardian’s consent.
14. Accountability
We keep the trust’s money in accounts in the trust’s name, need two trustee signatures for payments, and will publish a yearly summary of income and spending.
15. Law and complaints
These terms are governed by the laws of Kenya. Send complaints to winniewishestrust@gmail.com. Complaints about personal data can also go to the Office of the Data Protection Commissioner (www.odpc.go.ke).
